The wait before the bond
The most common frustration with a DWI arrest is not the bond — it is the hold. Many facilities will not release someone on a DWI until they are no longer impaired, regardless of whether a bond is ready to post. That is a jail decision, not a legal bail question, and no bondsman can shorten it.
What we can do is have everything in place so the release happens the moment the hold ends rather than hours later. Call us as soon as you know about the arrest, not once the hold has already expired.
First offense versus repeat
A first-offense DWI is usually a misdemeanor and often falls under the court’s bail schedule, which means a relatively straightforward and quick bond. Repeat offences escalate — third and subsequent DWI offences are felonies in Louisiana, with correspondingly higher bonds and closer judicial scrutiny. Conditions attached to DWI release
Courts frequently attach conditions to DWI bonds under Code of Criminal Procedure Article 320 — ignition interlock requirements, abstention conditions, and in some cases drug and alcohol testing. Since 2024, Louisiana law has also required pretrial drug testing within 24 hours of booking for certain arrestees. Violating a condition can revoke the bond and send someone back into custody, so make sure the conditions are understood before anyone leaves.
